Who these Terms cover. These Terms of Service are between you and WAN TECH SOLUTIONS LTD, trading as Wan Tech Solutions ("Wan Tech", "we", "us", or "our"). They apply to this website and to any app, software product, digital platform, or IT service operated by us that links to or expressly incorporates these Terms, on any supported platform.

1. Scope and contract documents

Our services include websites, mobile and desktop applications, cloud and hosted software, software development, design, digital platforms, consulting, networking, cybersecurity, support, and related technology services (the "Services"). A feature mentioned in these Terms applies only when that feature is actually offered in the Service you use.

Product descriptions, an accepted quotation or statement of work, an order, a service-level agreement, a data-processing agreement, or additional terms presented before a transaction may specify the product, supplier, functionality, compatibility, price, duration, support, or delivery arrangements. A separately agreed, more specific provision controls a conflict about its subject matter. Mandatory law, applicable consumer protections, and binding app-store purchase or licence rules remain unaffected.

Building software for a client does not automatically make Wan Tech the operator, seller, or data controller of the client's app. These Terms cover a client-owned product only where its operator expressly adopts them and accurately identifies the contracting trader. A separate legal entity's terms govern its own services.

2. Eligibility and acceptance

You must have the legal capacity to enter the relevant contract. If you act for an organisation, you confirm that you have authority to bind it. A minor may use a Service only where its age requirements and applicable law allow, with a parent, guardian, school, or other authorised adult's involvement where required. An adult must enter paid contracts on a minor's behalf where the law requires this.

We make these Terms available before you accept them or place an order. By expressly accepting them through an applicable sign-up, purchase, or contracting process, you agree to the version presented to you. If you do not agree, do not enter that contract or use the affected Service. Visiting this page alone does not place an order, start a subscription, or waive any consumer right.

3. Accounts and security

Where an account is required, provide accurate information, keep credentials confidential, and promptly tell us about suspected unauthorised access. Use the security controls available in the Service. Do not share an account in a way that bypasses licensed user limits or impersonates another person.

Organisations are responsible for managing their authorised users and permissions. You are responsible for activity you authorise or cause through a breach of your security obligations; this does not make you automatically responsible for activity caused by our security failures or override statutory payment protections.

4. Services and project delivery

For commissioned work, the accepted proposal or statement of work defines deliverables, milestones, acceptance criteria, client responsibilities, payment stages, and any ownership transfer. Changes to scope, budget, or delivery dates require agreement. You must provide the access, lawful materials, instructions, feedback, and approvals reasonably needed to perform the work.

Support hours, hosting capacity, backups, disaster recovery, maintenance, and response commitments are those expressly agreed for the affected Service. A general enquiry or this website does not create a managed-services contract or a guarantee of round-the-clock support. We will perform services with the care and skill required by applicable law.

5. Software licence and intellectual property

Subject to your applicable order and these Terms, we grant you a limited, non-exclusive licence to access and use the Service for its intended lawful purposes during the agreed period. You may not resell, sublicense, or transfer it except as your licence, platform rules, or mandatory law permits.

We and our licensors retain rights in our software, designs, documentation, branding, and pre-existing tools. You retain your own materials. Ownership of custom deliverables and access to source code are governed by the written project agreement; an invoice payment alone does not transfer all underlying tools or third-party rights. Open-source components remain subject to their respective licences, which prevail for those components.

Do not copy, modify, circumvent technical restrictions, or reverse engineer software except with permission or where applicable law permits it. Nothing here limits lawful interoperability, accessibility, security research, or other rights that cannot be excluded.

6. Your content and acceptable use

You must have the rights and permissions needed for content and personal information you provide. You grant us only the rights reasonably necessary to host, process, display, transmit, and back up that content to deliver and protect the Service, in accordance with the applicable privacy notice and contract. This is not a transfer of ownership or a general licence to sell your content.

You must comply with our Acceptable Use Policy. Prohibited activities include unlawful content, infringement, fraud, harassment, malware, unauthorised access, spam, and disruption. Where a Service supports user content, we may restrict unlawful or policy-breaking material using proportionate measures, subject to applicable notice and appeal requirements. Report concerns or challenge a decision through Support.

7. Prices, payments, and subscriptions

Before a paid order, the relevant offer or checkout must identify the seller, main features, total price, currency, applicable taxes and unavoidable charges, billing period, contract duration, and cancellation arrangements. No payment is due merely because you browse the website or contact us. Third-party connectivity and bank charges are your responsibility where disclosed or imposed by your provider.

Recurring billing applies only when clearly disclosed and accepted. A trial converts to a paid plan only under the terms and notices shown when you enrol. Manage a store-billed subscription in your Apple or Google account; manage a direct subscription through the controls supplied with the Service or by contacting us. Deleting an app or account does not by itself cancel store billing.

Renewal price changes require the notice and consent applicable law and platform rules require. An agreed price for an existing fixed paid period is not changed retrospectively by editing these Terms. Business payment milestones and any lawful late-payment arrangements must be set out in the relevant order.

8. Cancellation, refunds, and consumer rights

See our Refunds & cancellation policy for how to cancel or request a refund. Any voluntary refund offer is additional to statutory rights. We do not impose a blanket "no refunds" rule on defective, misdescribed, or unlawfully supplied digital content or services.

If you are a consumer, rights that cannot legally be waived remain yours, including applicable rights to information, conformity, reasonable care and skill, repair or replacement, price reduction, cancellation, and reimbursement. Depending on the transaction, EEA and UK distance-contract rules may provide a 14-day withdrawal period. Exceptions for immediately supplied digital content or fully performed services apply only when all legal conditions, including any required express consent, acknowledgement, and confirmation, are met. Accepting these Terms alone does not provide that consent or acknowledgement.

Nothing in these Terms removes mandatory protections in your country of residence, even where Ghanaian law is specified below.

9. Apple, Google Play, and other platforms

Purchases, billing, distribution, device permissions, and refunds through an app store are also subject to that store's applicable rules and your purchase agreement. Use the store's subscription and refund tools where it processes your purchase. Contact us for product support and statutory remedies for which we are responsible.

Apple App Store

Unless a valid custom licence is supplied for a particular app in App Store Connect, the app licence is governed by Apple's Standard End User License Agreement. These Terms additionally govern our connected Services and do not replace that licence or reduce its rights. Apple is not a party to our service contract. We are responsible for our app's support and legal obligations; Apple does not provide our maintenance or support. Apple purchase refunds follow its applicable terms and mandatory law.

Google Play and other channels

For Android apps and other distributions, these Terms apply alongside the applicable platform terms and any separately identified software licence. Google and other distributors are not responsible for our service obligations merely because they distribute an app. You must comply with applicable third-party terms, including network and device agreements. A platform's mandatory purchase rules control the transactions it processes.

10. Privacy and confidentiality

Our Privacy Policy explains the company website's information practices. An app or customer deployment must also provide the privacy information specific to its operator, data, permissions, processors, retention, and users. These Terms do not grant permission for undisclosed tracking, marketing, sensitive-data collection, or international transfers.

Where we process personal information on a business customer's instructions, the customer and Wan Tech must establish their respective responsibilities in an appropriate processing agreement. Each party must protect confidential information received for a project, use it only for the agreed purpose, and restrict disclosure to authorised recipients or legally required disclosures. Information already lawfully public or independently obtained is not confidential.

11. Availability, updates, and third parties

We may maintain, secure, and improve the Services, and will provide notices, updates, and remedies required by law or contract. We do not promise uninterrupted availability, absolute security, or compatibility with every device. We will not rely on a general change provision to remove paid contractual rights without the notice, consent, cancellation rights, or refunds that apply.

Third-party links and integrations have their own terms and privacy practices. Their presence is not an endorsement. Unless expressly included in your contract, our Services are not emergency services and must not be relied upon as the sole means of obtaining urgent assistance or making safety-critical decisions.

12. Suspension and termination

You may stop using a free Service or end a paid Service according to its cancellation terms. To request account deletion, follow the account and data deletion instructions.

We may restrict or suspend access for a material breach, an unlawful use, an immediate security risk, non-payment of undisputed amounts when due, or a legal requirement. Where reasonable and lawful, we will explain the reason, give an opportunity to remedy it, and provide a route to challenge the decision. Urgent protective action may be taken first.

On termination, licence rights end as specified in the relevant contract, and amounts properly due remain payable. Where legally and technically possible, we will allow a reasonable opportunity to retrieve your data. Data handling follows the applicable privacy notice, processing agreement, and retention obligations. Refund and consumer rights survive termination.

13. Warranties and responsibility

We honour express commitments in the relevant offer and all warranties that apply by law. Except for those commitments and rights, we do not guarantee that a Service will meet every unstated purpose, produce a particular commercial outcome, or always be error-free. Experimental or beta features must be identified as such before use.

For business customers only, and to the extent permitted by law, implied terms beyond the agreed specification are excluded. This exclusion does not apply to mandatory consumer protections or any obligation that cannot lawfully be excluded.

14. Liability

Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other responsibility that applicable law does not permit us to exclude or limit.

For consumers, we remain responsible for losses for which applicable law makes us liable, including reasonably foreseeable loss caused by our breach. We do not impose the business liability cap below on consumers or remove statutory digital-content remedies.

For business customers only, unless a separately signed agreement says otherwise and to the extent lawful, neither party is liable for indirect or consequential losses or loss of anticipated profits arising from the affected Service. Our aggregate liability arising from that Service is limited to the fees paid or payable for it during the 12 months before the event giving rise to the claim. The exclusions in the first paragraph and any legally non-excludable data-protection obligations remain unaffected.

15. Complaints, governing law, and disputes

Send questions, complaints, billing disputes, or legal notices to info@wantechsolutions.com, or use the trader address below. Include the relevant app or project name and enough information to investigate. We will consider complaints fairly and explain the next steps.

Ghanaian law governs these Terms, subject to mandatory laws protecting consumers in their usual country of residence. For business contracts, the competent courts of Ghana have jurisdiction unless a signed agreement states otherwise. Consumers retain any right to bring proceedings in their local courts and to contact a competent regulator or dispute-resolution body. These Terms do not impose mandatory arbitration or waive collective rights that cannot lawfully be waived.

16. Changes and general provisions

We publish the effective date and version of these Terms. For an ongoing contractual relationship, we will give reasonable advance notice of material changes, normally at least 30 days where practicable, and obtain consent where required. An urgent legal or security change may need a shorter notice. Changes do not retrospectively alter an existing claim or completed purchase. You may reject a proposed material change by ending the affected Service before it takes effect, subject to applicable cancellation and refund rights.

If a provision is unenforceable, the rest remains effective to the extent lawful. A delay in exercising a right does not waive it. A transfer of our contract must not reduce your mandatory rights; we will give any required notice. These Terms and the applicable accepted contract documents form the agreement for their subject matter, without excluding remedies for fraud or legally protected pre-contract statements.
